Motorcycle vs. Truck Collision Case Example

Posted by Michael Flinn on August 13, 2013

I am reporting the successful policy limits settlement of a motorcycle v. truck collision in which the motorcycle driver was severely injured. The driver pulled out of a cross road and our driver was unable to avoid impact.  The defendant driver claimed that the motorcycle driver was speeding. The trucking company filed bankruptcy.  The insurer pulled out all the stops in an effort to avoid liability including hiring two accident reconstruction firms and having the motorcycle inspected twice.  The insurer claimed that an EMT smelled alcohol on the client but ER records indicated no alcohol on testing.  We were able to maneuver the insurer into a positive response to our time limited policy limits demand.
